What the regulation says about electricity
Point 2 of Annex III is headed as the list of third countries and territories outside the scope of the regulation for the importation of electricity into the customs territory of the Union. It names nothing. The text reserves the point for countries and territories that the Commission adds or removes pursuant to Article 2(11), so the list stands empty as the regulation is written.
Article 2(3a) is separate from that list. It puts outside the regulation the electricity generated on the continental shelf or in the exclusive economic zone of a Member State or of a country or territory listed in points 1 and 2 of Annex III, and the hydrogen originating on the continental shelf or in the exclusive economic zone of a Member State or of a country or territory listed in point 1.
How origin is decided
Whether goods originate in one of these countries is not decided on this page. Article 2(5) sends the question to the rules for non-preferential origin referred to in Article 59 of Regulation (EU) No 952/2013, and those rules decide it.
What this page does not yet carry
A country that is inside the mechanism may still operate a carbon price of its own, and a price paid there can be deducted. A page for each exporting country follows, written from that scheme’s own instrument, and none is published until that instrument has been read.
Where this was read
The list was read in Annex III to Regulation (EU) 2023/956, point 1, in the consolidated text as at 20 October 2025, on 13 October 2026, in the consolidated text on EUR-Lex.
